Colorado’s SB 24-205, the country’s first comprehensive AI antidiscrimination statute, won’t take effect as written. Governor Jared Polis signed a narrower replacement, SB 26-189, on May 14, four days after sine die, after a federal court froze enforcement of the original at the joint urging of xAI and the U.S. Department of Justice.
The collapse took six weeks. On April 9, xAI sued Colorado Attorney General Phil Weiser, alleging SB 205 compelled speech and violated Equal Protection by carving out “diversity”-motivated algorithms from liability. DOJ intervened April 24, with Civil Rights Assistant Attorney General Harmeet K. Dhillon declaring that laws requiring AI firms “to infect their products with woke DEI ideology are illegal.” On April 27, Magistrate Judge Cyrus Y. Chung entered a stipulated order halting enforcement until 14 days after any preliminary-injunction ruling. Lawmakers introduced SB 189 on May 1.
What survives is a notice regime, not a civil-rights one. SB 26-189 drops the mandatory impact assessments and attorney general disclosures that defined SB 205. It keeps consumer notice, an explanation right, data correction, and human review, and gives deployers 30 days after an adverse outcome to provide a plain-language description of the automated decision-making technology’s role. Effective date: January 1, 2027.
McDermott Will & Emery’s read is that both xAI and DOJ are expected to challenge SB 189 as well. That’s the part other state capitals should be reading carefully. The compelled-speech theory the DOJ just validated isn’t Colorado-specific; it’s a constitutional argument against the entire category of state algorithmic-accountability law. Colorado moved first and was the first to fold. Its replacement statute is itself now the next test case.
