Gov. JB Pritzker signed Executive Order 2026-07 on Tuesday, creating an unpaid Illinois AI Cabinet drawn from academia, law, ethics, governance, and eight state agencies, and charging it with recommendations due through 2027. Among the questions the governor’s office wants answered: “whether a strict-liability framework for AI-caused harm is an appropriate mechanism for holding AI companies accountable.”

That’s not a rhetorical question. Strict liability, if adopted, would make deployers answer for downstream harms regardless of intent or negligence, a standard normally reserved for defective products and ultrahazardous activity.

The cabinet, which will also weigh conditioning data-center tax incentives and permits on safety standards and folding AI accountability into state procurement, sits atop an already-active regime. In July 2026, Pritzker signed Senate Bill 315, the Artificial Intelligence Safety Measures Act, which mandates annual third-party audits of the largest models starting in 2028. DoIT, IEMA, IDFPR, and the Illinois Commerce Commission are all inside the cabinet’s perimeter, which telegraphs how broadly Springfield now defines the AI surface area: infrastructure, financial services, professional licensing, and utilities.

Members will be named “in the coming weeks.”

The Illinois posture is legible only against the federal vacuum. The Senate’s frontier AI safety bill that would flatten the state patchwork remains stalled, and the White House AI czar search launched Monday hasn’t produced a name. Pritzker, who has publicly called the federal posture too lax, is filling that silence.

For Illinois small businesses using AI in lead generation, customer messaging, or sales workflows, the practical read is narrow but real. Procurement standards travel downstream through vendors. A strict-liability regime, if recommended and enacted, changes who owns a mistake. Neither is theoretical anymore; both are on a 2027 calendar.
