Sens. Josh Hawley (R-Mo.) and Chris Murphy (D-Conn.) announced the bipartisan AI Agent Accountability Act on Oct. 1, a proposal that would extend Computer Fraud and Abuse Act liability, criminal and civil, to anyone involved in the “knowing operation of an AI agent that recklessly causes computer hacking damage or loss.” Developers would face parallel exposure for failing to implement reasonable safeguards, and both the U.S. Attorney General and state AGs would get express authority to sue to enjoin violators. Murphy’s framing is unsubtle: companies should “develop responsibly or face prison time.”
The announcement followed a Sept. 30 Senate Homeland Security subcommittee hearing Hawley chaired on rogue agent incidents, per IAPP. Read in that sequence, the bill is less a surprise than a scheduled next move.
The practical read is where it gets interesting for small businesses. The press releases don’t carve out downstream users, and the word “operator” is doing enormous work. A five-person company running a browsing agent that researches prospects, or an outreach bot that pings leads across third-party platforms, is plausibly the operator, not just the vendor that shipped the model. Vendor contracts that quietly push liability downstream stop being an IT concern and become a legal one.
Context matters. Per Axios, the Trump administration’s AI czar structure favors self-regulation, and broader federal AI legislation is otherwise dead until 2027. A narrow liability bill grafted onto an existing statute is the easier legislative lift, which is precisely why this one is worth watching.
No bill text, number, or committee referral exists yet. The window to audit which agents touch outside systems, and under what documented authorization, is the window before that changes.
