The New Jersey Assembly Science, Innovation, and Technology Committee heard three AI bills from Assemblyman Andrew Macurdy (D-Summit) on Oct. 19 without taking a vote, moving Trenton closer to a disclosure regime that would reach straight into the marketing stack of any business serving New Jersey consumers.
The centerpiece for small-business operators is A5089, the AI Image Disclosure Act. It would require any AI-generated image, video, or audio used commercially to carry both a conspicuous human-readable label and a machine-readable latent watermark, backed by a $5,000-per-violation civil penalty with each day counted separately. The bill’s effective date is Feb. 1 of the calendar year after enactment, a short runway for anyone whose ad creative, product photography, or social posts rely on generative tools.
A5090, the GAI Accountability Act, raises the stakes to $20,000 per violation, enforced by the attorney general. A5275 would compel frontier-AI developers to disclose safety procedures to the AG and permit audits by contracted private entities, per New Jersey Monitor.
Industry pushed back. Jack Ramirez of the New Jersey Business and Industry Association told the committee the $5,000-per-day fines “would be too much for small and mid-sized AI firms to bear,” and warned the New Jersey Globe that state-specific rules create “a multitude of problems” for products built for nationwide use. Macurdy countered that penalties have to be large enough to move firms “valued at close to $1 trillion,” naming Anthropic.
The patchwork argument is doing real work here, because the patchwork is real. New Jersey is one of six states still in session this year, per the Transparency Coalition, and it’s walking into terrain already shaped by Connecticut’s CART Act and NYC’s 10-bill AI package. No votes are scheduled. The compliance calendar, however, is already written into the bill.
